Welcome to the Mzansi Marketplace Agent Program. By participating, you agree to these Terms and Conditions, which form a binding agreement between you ("Agent") and Mzansi Marketplace ("Platform"), a company registered in South Africa.
Mzansi Marketplace is fully compliant with the Protection of Personal Information Act 4 of 2013 and the Consumer Protection Act 68 of 2008, ensuring your rights are protected.
1. Agent Responsibilities
Agents are responsible for referring new sellers to the Platform using their unique referral link. You must act in good faith, comply with South African laws, including the Consumer Protection Act 68 of 2008 (CPA), and avoid misleading or deceptive practices. For example, in the case of National Consumer Commission v Dis-Chem Pharmacies (2022), misleading marketing practices led to penalties for non-compliance with the CPA.
2. Commission Structure
Agents earn a signup bonus and ongoing commissions as outlined in the "Fees and Earnings" section of the Support page. Bonuses are paid after a 7-day verification period to prevent abuse. Ongoing commissions are calculated as 20% of the Platform’s cut from seller withdrawals. Payments are subject to tax obligations under the South African Income Tax Act 58 of 1962.
3. Termination
The Platform may terminate your participation if you engage in fraudulent activities, violate these terms, or harm the Platform’s reputation. Upon termination, unpaid commissions may be forfeited, except where prohibited by law. You may terminate your participation by written notice to support@mzansimarketplace.co.za.
4. Compliance with Laws
You must comply with the Protection of Personal Information Act 4 of 2013 (POPIA) when handling personal information of referred sellers. This includes obtaining consent for sharing data and ensuring confidentiality. In the 2023 Information Regulator v SAPS case, improper sharing of personal data led to enforcement action, highlighting the importance of POPIA compliance.
5. Limitation of Liability
The Platform is not liable for indirect, incidental, or consequential damages arising from your participation, except where such limitation is prohibited by South African law, such as the CPA, which mandates fair business practices.
6. Amendments
The Platform reserves the right to amend these terms at any time. Changes will be communicated via email or the agent dashboard, with 30 days’ notice as required by the CPA. Continued participation after changes constitutes acceptance.
7. Dispute Resolution
In case of disputes, we encourage resolution through dialogue. If unresolved, disputes may be referred to mediation under the Consumer Protection Act 68 of 2008. Contact our support team or the Consumer Goods and Services Ombud at info@cgsosa.co.za.
